TERMS & CONDITIONS
1. Application of terms and conditions
In these terms and conditions, reference to “we” and “us” means CARPENTERS FIJI LIMITED trading as MORRIS HEDSTROM and “our” has a corresponding meaning.
“You” means you, our customer, under these terms and conditions and “your” has a corresponding meaning.
While MH’s has endeavored to ensure that the information provided on the MH’s Online shop is free from error, we do not warrant its accuracy, adequacy or completeness, and to the extent permitted by law we shall not be responsible or liable for any error in, or omission from, the information provided on the MH’s Online shop. We reserve the right to make changes to the information provided on the MH’s Online shop at any time and without notice.
Your placement of an order via the MH’s Online shop is an offer to purchase our Products in accordance with these terms and conditions. We may accept your order by processing your payment and shipping the Product, or may, for any reason, decline to accept your order or any part of your order. No order shall be considered to be accepted by us until the confirmation has been provided through email
If any credit transaction is discovered to be fraudulent, MH’s will proceed with investigation to analyze the occurrence and facilitates to debit your account. This process will depend on the nature of the transaction.
To make a purchase from the MH’s Online shop on your own behalf:
a). You must be 18 years of age or over,
b).You must be either purchasing on your own behalf or authorised to purchase on behalf of another person.
If you are purchasing on behalf of a company, association, partnership or other such entity (“Entity”):
you are deemed to be authorised to agree to these terms and conditions on behalf of the Entity;
you are deemed to be authorised by the Entity to make the purchase;
you are deemed to be authorised to use the Entity’s credit card used to make the purchase; and
references in these terms and conditions to “you” include the Entity (as defined above).
By purchasing from the MH’s Online shop, you warrant that you meet the relevant conditions set out in clauses 2.3 and 2.4 above.
When making a purchase from the MH’s Online shop, you must provide all required information (including your name, contact details, and credit card details) failing which we may not be able to process your order.
At our sole discretion, you may not be able to proceed with any purchase on the MH’s Online shop which exceeds our current Retail quantity limits on volume or total value.
All orders are subject to the availability of Products.
Should there be an error in the price or information in respect of any Products that are listed on MH’s Online shop, or if product is not available, we reserve the right to cancel your order for those Products (regardless of whether you have made payment for that order). Where you have already made payment for an order that is subsequently cancelled by us, we will refund the amount paid by you in relation to that order, refund will be free of any additional charges.
Although we endeavor to accurately display and describe the colours and/or specifications of the Products, we do not guarantee the colour and/or specifications of any product delivered to you will exactly match the specifications of any image of that Product on the MH’s Online shop (as the colours displayed on your computer system or in printed form may vary).
3. Price of products and payment
The price payable for Products ordered by you shall be the price displayed on the MH’s Online shop at the time your order is submitted (subject to clause 2.9 above), together with the applicable delivery charges. Unless expressly stated otherwise, all prices displayed on MH’s Online shop are stated and payable in Fijian dollars and include VAT. All purchases will be charged to your credit card at the exchange rate applicable at the time of purchase.
Products displayed on MH’s Online shop, and their prices, are subject to change without notice.
The Total Payment to be made for the purchased product will include additional charges like Freight, Customs, duty, fumigation, Insurance, and so forth.
All Flash & Gain customers can email/fax the copy of their receipt and card numbers to Flash & Gain Dept on email address: firstname.lastname@example.org or fax no: 3315689.
We are unable to deliver perishable and frozen goods to maritime areas and outer islands except for Vanualevu, Taveuni and Ovalau.
4. Delivery & Title
We deliver only within Fiji. We do not ship overseas.
When placing an order for delivery and pickup, it is mandatory for you to provide the following:
Name of Recipient.
Physical street address. (Delivery cannot be made to a Postal Box).
Contact Details (Mobile/Landline Number).
Your nominated authorized recipient needs to be at the delivery address to sign for the goods (photo identification is required – FNPF, Voter Registration card and or valid Driver’s License). We cannot deliver without an authorized recipient’s signature acknowledging the receipt of the goods.
Delivery of goods will be done during business hours between from Monday to Friday 8am- 5pm.
We will endeavor to dispatch your order within 3 – 10 business days (except for Maritime stores) once we have confirmed that we have accepted your order and received all amounts payable for your order. We will follow the shipping schedule for delivery to outer islands.
If we are unable to dispatch your order or have your order ready for pick up within this time frame we will endeavor to contact you and advise you of the expected dispatch or pick up date. We will endeavor to provide you with email confirmation of dispatch or pickup within 3 working days of dispatch or pickup.
Delivery costs will be added to the total order cost, depending on the delivery location as follows:
Within City / Town Limits (5km Boundary) $15.00 VIP
Outside City / Town Limit (10km Boundary) $25.00 VIP
Outside Boundary (Above 10km) $25.00 + (1.5 * Additional km) VIP
Outside Viti Levu/Vanua Levu (e.g. Lau Group, Lomaiviti Group & Rotuma) Additional boat charges and delivery will be applicable.
*These rates may vary from time to time and are subject to change without any notice.
The above mentioned clause (4.7) does not apply where you opt to pick up the items from the nominated stores.
Although we will endeavor to meet delivery timeframes where possible, all delivery or pickup timeframes are estimates only and we will not be liable for any loss, expense, or other damage caused by any delay in delivery or pickup.
After three unsuccessful attempts to deliver your order we will contact you and you will be required to arrange pickup from the nominated store. You will be required to provide proper recipient identification, failure to collect your order within the designated 14 days will result in your order being cancelled and a refund will be issued after the deduction of handling charges.
The pickup will only be taking place upon the presence of the beneficiary at nominated store for collection (photo identification is required- FNPF, Voter Registration Card Or Valid Driver’s License). We will only dispatch goods to authorized/nominated recipients.
Title to, and risk for, each Product you order from the MH’s Online shop passes to you when the Product is delivered to you.
Where you believe that incorrect Products have been delivered, you must contact us with any such claim within 14 days of delivery and you must provide us with a reasonable opportunity to investigate that claim. Investigation of claim may take upto 7 working days.
5. WARRANTY AND RETURN POLICY
Upon receiving the goods, it is your responsibility to check the goods properly for any visible defects and to exercise due diligence in checking the goods upon delivery.
If you discover any defect in your product, you may return the item in new condition within 7 days of delivery for a replacement. If a replacement is not available we may at our sole discretion provide a refund. You will be notified by email of the status of the replacement.
For defects in perishable goods or produce, you must return the items within twenty four (24) hours of delivery.
For any return of Homemaker items due to faults then the Manufacturer’s warranty applies.
In the event Extended Warranty is purchased then the terms and conditions of the Extended Warranty applies.
Replacements or refunds do not cover faults arising from:
Normal wear and tear, or
Changes to the original item, or
Damage caused by perfume, hairspray, chlorine, water or other agents, or
Damages to the goods caused by you or any other person, either deliberately or accidental.
For any claim to be made the item must be sent to the MH’s store from where the goods were dispatched.
When returning your defective goods, please ensure you have the original copy of your receipt and reference number.
Goods returned can only be exchanged for same or like products. You are not entitled to reimbursement in cash or any monies over-the-counter. MH’s may exercise its sole discretion to credit the refund amount on your credit card.
6. Change or cancellation of an order
If you wish to change or cancel an order, contact our E-Commerce Officer at any time during business hours between 8am to 5pm Fiji Time, from Monday to Friday on (679) 331 5299 or email email@example.com. Orders can be changed or cancelled within 24hours of receipt of confirmation.
7. Security and user conduct
You are responsible for all of your activity in connection with accessing the Website. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your access to the Website.
You may not post or transmit, or cause to be posted or transmitted, any communication or solicitation designed or intended to obtain personal data from any Website user.
Ordering from our online store is a completely encrypted, secure process using secure socket layer (SSL) technology. This is one of the safest ways to transmit your information over the internet as all your information is encrypted during transmission.
Morris Hedstrom is committed to protecting your privacy. We do collect information from you to process your orders. You are rest assured that we do not sell, rent or otherwise trade your personal information to any third party.
If you prefer, you can fax your order to your closest distribution centre. Simply print out your shopping basket after collecting the items you wish to buy and fax it through to us with your payment details.
We reserve the right to change these terms and conditions from time to time by publishing the changed terms on the MH’s Online shop. When revised terms and conditions are published on the MH’s Online shop, all orders submitted by you after the revised terms and conditions are published shall be subject to the terms and conditions as revised.
If any provision of these terms and conditions is held to be invalid or unenforceable for any reason, the remaining provisions shall, to the maximum extent possible, remain in full force and effect.
We shall not be liable to you for any delay or non-performance of our contractual obligations to the extent that such delay or non-performance is caused by an event or circumstance which is outside our reasonable control.
You shall be solely responsible for obtaining any necessary permits under (and for compliance with) all legislation, regulations, by-laws and rules that apply to the use of any Products you purchase from us.
We reserve the right, without notice and in our sole and absolute discretion, to discontinue, suspend or terminate any service offered by or through this Website as well as this Website at any time.
These terms and conditions (and any orders to/from the MH’s Online shop) shall be governed by the laws of Fiji Islands and the courts of Fiji Islands shall have exclusive jurisdiction to hear and determine any dispute arising in relation to these terms and conditions (and any orders from the MH’s Online shop).
